A notice of appeal filed before disposition of a listed post-judgment motion is always void and can never become effective. If a party timely files one of the post-judgment motions listed in FRAP 4(a)(4), the time to appeal runs from entry of the order disposing of the last such remaining motion. A timely Rule 59 motion has no effect on the notice-of-appeal deadline. The notice deadline is tolled by a motion to compel discovery filed after judgment.
